By entering, you (the “Entrant”) agree to the following rules, terms and legal conditions:
SPONSOR
The Redmond Hunt Trail Cam Contest (the “Contest”) is sponsored by Redmond Minerals, Inc., a Utah corporation whose principal place of business is located at 2725 N 100 W Redmond, UT 84652 (hereafter “Sponsor”).
TERM
The Sponsor may hold a unique Redmond Hunt Trail Cam Contest each calendar year by posting notice of such on its redmondhunt.com website (hereafter “Website”). The term of any Redmond Hunt Trail Cam Contest shall commence on the 1st day of January of any given year and shall continue until 11:59:00 p.m. U.S. Mountain Standard Time on December 31 of that year. Each unique calendar year Redmond Hunt Trail Cam contest will be designated by the year in which such contest takes place. E.g., “2018 Redmond Hunt Trail Cam Contest.”
WHO MAY ENTER
The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who have reached the age of 18 at the time of entry. CONTEST IS VOID WHERE PROHIBITED.
JUDGING
Each entry will be judged separately, using subjective criteria determined by the Sponsor in its sole discretion.
PRIZES
The Sponsor will award grand prizes within a reasonable time following the conclusion of the Contest. The actual prizes to be awarded and the value of such will be determined by the Sponsor in its sole discretion. The Sponsor will post notice of such prizes on its Website within a reasonable time from the commencement of any calendar year. The Sponsor may also, in its sole discretion, award any number of “runner up” prizes with a value to be determined by the Sponsor.
All prizes are non-transferrable, no substitution is permitted, and no cash alternative is available. If a prize (or part of a prize) is unavailable, the Sponsor, in its sole discretion, reserves the right to substitute the original prize (or part of that prize) with an alternative prize of equal monetary value and/or specification. Potential winners will be required to sign and return to the Sponsor an Affidavit, License, and Indemnification Agreement. Failure to execute and deliver any required document to the Sponsor may result in disqualification from the Contest, and selection of an alternate potential winner.
TAXES
Contest winners will have sole responsibility for all federal, state, and local taxes, fees and surcharges on any prize awarded in connection with the Contest. In the event Entrant is selected as a potential winner he or she also agrees to execute and return to Sponsor an Internal Revenue Service W-9 Request for Taxpayer Identification Number and Certification form (“W-9 Form”). Failure to complete the W-9 Form may result in disqualification from the Contest, and selection of an alternate potential winner.
PHOTOS
Photographs must be uploaded to the Sponsor’s Website in .jpg format to be eligible. Each photograph entered into the contest, must be a single work of original material taken by the Entrant and Sponsor’s Redmond Hunt brand product must be visible in the photograph. An image that combines the elements of more than one photograph or has elements removed is not eligible. By entering the Contest, Entrant represents, acknowledges and warrants that the photograph is natural, unadulterated, unmodified, and genuine and that any animal wildlife in the photograph is wild, undomesticated, and alive at the time of the photograph. Entrant further represents, acknowledges and warrants that the submitted photograph is an original work created solely by the Entrant, that the photograph does not infringe upon the copy rights, trademarks, rights of privacy, publicity or intellectual property rights of any person or entity and that no other party has any right, title, claim or interest in the photograph and that and that Entrant has obtained any necessary permissions from any third party if a third party or third party’s property appears in the photograph.
LICENSE
Selected entries and the entrants’ names may be published by Sponsor in Sponsor’s advertising, or on its Website, or in any other medium, at the Sponsor’s discretion. By entering the Contest, Entrant grants a royalty free irrevocable perpetual non-exclusive license to Sponsor, to reproduce, distribute, display and create derivative works of any photographic entry (along with a name credit) in connection with commercial use and exploitation of the entries to the fullest extent possible, in any media now or hereafter known, including, but not limited to: Sponsor’s website, Posters displaying entries, or publications featuring select entries in the Contest. However, display or publication of any entry on the Sponsor’s website does not indicate the entrant will be selected as a winner. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by entering, each entrant grants to Sponsor the unrestricted right to use all statements made in connection with the Contest, and pictures or likenesses of Contest entrants, or choose not to do so, at their sole discretion. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such use.
LIMITATION OF LIABILITY
By entering the Contest, Entrant agree to release, discharge and hold harmless Sponsor and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities, including travel, and the acceptance and use, misuse, or possession of any prize awarded hereunder.
RIGHT TO CANCEL OR SUSPEND CONTEST
If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsor elects to cancel or terminate the Contest, Sponsor may retain the rights mentioned above in the submitted photographs.
DISPUTES
By entering the Contest, Entrant agrees that any and all disputes relating to the Contest, and causes of action arising out of or connected with the Contest, shall be resolved, individually, without resort to any form of class action, under the laws of the State of Utah, without regard to its conflicts of laws provisions. Entrant further agrees that the exclusive forum for any actions arising out of or relating to the Contest shall be the appropriate state or federal court sitting in Salt Lake County, State of Utah.
DATA PRIVACY
Entrants agree that personal data, especially name and address may be processed, shared and otherwise used for the purposes and within the context of the Contest. The data may also be used by the Sponsor in order to verify the Entrant’s identity, postal address and telephone number or to otherwise verify the Entrant’s eligibility to participate in the Contest.
